General Terms and Conditions of Service
These TERMS AND CONDITIONS ("Agreement") constitute your agreement with Best Day Appliance LLC and will apply to your service order. This agreement is subject to regular updates without prior notice or permission.
NON-REFUNDABLE SERVICE FEE
Service Fee Policy:
We charge a non-refundable service fee ("Service Fee") for all non-warranty visits to your residence or business. The Service Fee will be quoted to you prior to our visit and covers costs incurred by us for travel and the performance of diagnostic services by a trained Best Day Appliance technician. If the unit is found to be uneconomical to repair or if you decide not to proceed with the service, the Service Fee will still be charged.
Additional Appliances:
Please note that additional appliances requiring service will each incur a separate Service Fee. However, we offer a discounted rate for servicing additional appliances during the same visit. The exact discount will be communicated to you when scheduling the appointment.
Acknowledgment:
By accepting the Service Order, you acknowledge and agree to:
- Pay the Service Fee in full for each appliance, whether Best Day Appliance performs the recommended repairs or not.
- Understand that the Service Fee(s) will be credited toward the cost of repair if you agree to have Best Day Appliance perform the recommended repair or replacement.
REFUND POLICY
We offer no refunds on the Service Fee. Parts are non-refundable once ordered, as we commit to purchasing them from our suppliers on your behalf. If a repair cannot be completed or is canceled, the cost of the parts remains your responsibility. This policy helps cover our costs for parts procurement and ensures that we can continue to offer timely and efficient service to all our clients.
If a repair cannot be completed or is canceled, both the 50% parts deposit and the 50% labor deposit are non-refundable. This policy helps cover our costs for holding appointment slots, administrative processing, supplier commitments, and resources allocated to your repair that could have been allocated to other clients. We ask that you carefully review the estimate before agreeing to the repair.
DEPOSIT POLICY
After accepting an estimate, you are required to pay 50% of the parts cost and 50% of the labor cost upfront before we place the order for parts. This upfront payment is necessary for several reasons:
- Administrative and Processing Costs: Covers the time and resources spent processing your order, coordinating with suppliers, and managing logistics.
- Supplier Commitments: We often need to pay suppliers upfront for parts, which are non-refundable and may not allow cancellations or may charge restocking fees.
- Technician's Time and Expertise: Reflects the professional services provided during the initial diagnosis and preparation for your repair.
- Operational Costs: Helps offset ongoing business expenses and the opportunity cost of allocating resources to your repair.
Please note that the Service Fee is paid in full regardless of whether a follow-up appointment with parts is necessary or any other situation where the technician must return on a later date.
If the appointment is canceled before the next parts installation appointment, both the 50% parts deposit and the 50% labor deposit are non-refundable due to the reasons outlined above.
DAMAGE CLAIMS & CALLBACKS
If the technician concludes that the reported issue is not caused by our prior service or repair, we will charge a Service Fee, due at the time of the visit.
ESTIMATE
You are responsible for reviewing the estimate with the technician. Payment of parts and/or labor indicates your approval and complete agreement to have Best Day Appliance repair the appliance at the price quoted on the estimate.
The estimate section of the Service Order summarizes the costs for the parts and services we estimate are required to repair your appliance(s) ("Estimate Quote"). By accepting the Service Order, you agree to the terms of the Estimate Quote and the agreed-upon scope of work. If applicable, sales tax is included in the Estimate Quote.
REPAIR COST
The repair costs are in accordance with "The Major Appliance Service National Price Guide (MASPG)." The repair cost is based on the job, not on the time the repair takes to perform.
PARTS
Parts will be ordered within 24 hours of the initial visit. Depending on part availability, most parts will arrive within 1-3 business days. Special order parts may take longer. We can only relay ETA information provided by our part distributors.
After acceptance of the estimate and receipt of the required deposits, the technician will schedule the follow-up appointment for parts installation. If the part is backordered, we will contact you to schedule the appointment once the part arrives.
Please note that all parts are non-refundable once ordered, as they are specifically procured for your repair needs.
Best Day Appliance reserves the right to retain old parts and components replaced by our service technicians.
PAYMENT TERMS AND COLLECTION COSTS
Payment is due and will be collected upon completion of the services unless we agree otherwise in writing or arrangements are made prior to the repair. Payment may be made by check or credit card. Any dishonored check or bank draft will be charged a processing fee of $30.00. You agree to pay all expenses incurred by Best Day Appliance for the collection of any unpaid amounts, including but not limited to attorney's fees, filing fees, and costs. Past due amounts shall bear interest at the annual rate of 18%, or the maximum allowed by law, whichever is less.
CANCELLATION OF SERVICE
When scheduling service with us, we specifically allocate a technician's time to call on your location and service your product. When you forget, cancel, or change your appointment without giving enough notice, we miss the opportunity to fill that appointment time, and clients on our waitlist miss the opportunity to receive services. Consequently, we reserve the right to charge 100% of the Service Fee amount for any appointment missed, canceled, or changed without 8 business hours' notice or otherwise mutually agreed upon.
LIMITED WARRANTY
Best Day Appliance offers a 1-year warranty on labor and parts (see exclusions below). The warranty applies to the same problem. There is no warranty against additional or more extensive repairs, against other problems that may occur on the same unit (even if involving what appear to be identical symptoms), or against incidental damages.
If during this 1-year period, a problem arises or you discover a defect in the repairs, parts, or service, you must contact Best Day Appliance immediately to schedule a follow-up appointment to address the issue. The warranty is only valid if the repair is performed by Best Day Appliance technicians. Improper usage of the appliance automatically voids the warranty. The warranty is void on relocated appliances. If you do not perform proper maintenance, the warranty will be void.
If the service technician is dispatched on a unit under warranty and the complaint cannot be duplicated, the technician will not perform any other action other than testing the unit. If the technician is dispatched more than two times under warranty and cannot detect an error within the unit, you will be liable for a Service Fee.
No warranty on damage caused by external problems or interference by anyone else (other than Best Day Appliance technicians) tampering with the repair. The warranty is NOT applicable to the following parts: discontinued or obsolete parts, refrigerants, filters, access valves, fuses, wires. The warranty covers manufacturing defects only. The warranty does not cover damage due to water, high voltage fluctuations, or any alteration or tampering by third-party technicians.
The foregoing warranties do not apply to the following:
- Repair or replacement of any appliances used for commercial or industrial applications.
- Cosmetic or non-functional parts, including but not limited to glass, trim, knobs, panels, racks, tanks, tubs, baskets, structural parts, doors, door liners, and shelves.
- Plumbing supply water lines to any appliance, whether replaced or recommended for replacement by Best Day Appliance.
- Repair of any appliance that has been moved from the location at which it was originally repaired or installed by Best Day Appliance.
- Repairs on appliances for which parts are no longer available from the original manufacturer.
- Discontinued or obsolete parts, refrigerants, filters, access valves, fuses, wires.
Best Day Appliance shall be under no legal obligation to honor any warranty set forth herein unless you have paid all amounts owed under the applicable Estimate Quote. Best Day Appliance reserves the right to limit or refuse to provide warranty at its sole discretion. Best Day Appliance's obligation for defective parts and/or workmanship, and your exclusive remedy, shall be limited, at Best Day Appliance's option, to the replacement of any defective parts or workmanship or the refund of amounts paid by you for the service and parts. All warranty claims are subject to inspection and approval by Best Day Appliance.
The warranty will be void if: routine maintenance is neglected, improper use of the appliance, the unit is removed/uninstalled, the unit is damaged by weather, damage or interference by anyone else (other than Best Day Appliance), and/or non-payment of service.
THE WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THESE WARRANTIES EXTEND ONLY TO THE CUSTOMER.
LIMITATION OF DAMAGES
We are not liable for any item or person hurt by a malfunction and are not liable if your food spoils due to lack of refrigeration. If water leaks during our repair, we are not responsible for any damage done. Best Day Appliance is not responsible for any damage caused by appliance malfunction. Best Day Appliance is not responsible for any floor, cabinet, counter damage, or water leakage when repairing and/or removing your appliance by our technician(s).
BEST DAY APPLIANCE SHALL NOT BE RESPONSIBLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY IN CONNECTION WITH THIS AGREEMENT. BEST DAY APPLIANCE'S LIABILITY FOR DAMAGES IS LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CUSTOMER. THIS LIMITATION DOES NOT APPLY TO CLAIMS FOR PERSONAL INJURY.
INTERMITTENT CONDITION
There is absolutely no labor warranty on any unit with an intermittent problem. Since the problem is not always apparent, it cannot be traced. The only time such a problem can be traced is when the problem actually exists.
BASIC APPLIANCE INSTALLATION TERMS AND CONDITIONS
Our standard install charge covers the following:
- Removal and/or installation of an appliance without the need to disturb/remove cabinetry, countertops, flooring, or any other fixture. Does not include modification or repair of gas, water valves, drains, power receptacles, electrical junction boxes, and dryer vents.
- It is your responsibility to ensure systems for the supply of gas and water, electrical, drainage, venting, etc., meet local building codes and are available to facilitate installation using standard materials associated with the install of that type of appliance.
Best Day Appliance does not install, modify, or correct problems with services necessary to facilitate installation. These include but are not limited to electrical supply, water supply, water drainage, gas supply, dryer air vents, and ventilation systems to facilitate cooling and/or safe operation of equipment installed.
We assume and accept that the area, systems, or services provided to accommodate the appliance installation have been prepared to conform to the needs of the appliance and meet all applicable regulatory requirements and codes. We do not verify correct ventilation, electrical, water supply, and water drainage requirements have been met specific to the appliance installed.
If Best Day Appliance is supplying the appliance, doorways and hallways must allow sufficient clearance to move the unit into the install location.
The installation charge quoted does not include the cost of materials such as vent hoses, water lines, gas lines, hoses, fittings, etc.
Where two people are required to install an appliance, such as with stacked dryers/washers and wall ovens, this will incur an additional service charge in addition to the charge for the basic install.
Should we arrive to perform an install and find that installation cannot proceed and cannot be corrected while on site due to any one of the above criteria not being met, our standard Service Fee will be due.
CUSTOMER RESPONSIBILITIES
- Ensure an individual 18 years or older is present at the time of service.
- Ensure a form of payment will be available for the Best Day Appliance technician during the scheduled visit.
- Ensure the appliance is readily accessible to the service technician; if you have a stackable washer and dryer, dismount the unit before the technician arrives (e.g., emptying the appliance if possible).
- Keep small children and pets out of the technician's work area.
- Ensure all pets are controlled when the technician is at the house.
- Do not smoke cigarettes around our technicians.
ENTIRE AGREEMENT
These General Terms and Conditions of Service and each Service Order constitute the complete agreement ("Agreement") between Best Day Appliance and you, and supersede all prior or contemporaneous agreements or representations, written or oral.
GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the Commonwealth of Virginia without regard to its choice of law principles. Any disputes arising under this Agreement shall be finally resolved by binding arbitration conducted by the American Arbitration Association in Richmond, Virginia, in accordance with the Federal Arbitration Act and pursuant to the Commercial Rules of the American Arbitration Association. If the Federal Arbitration Act is inapplicable, then the Uniform Arbitration Act, Code of Laws of Virginia, as amended, shall apply.
DAMAGE WAIVERS
It is your responsibility to familiarize yourself with waivers we have in place surrounding the provision of any services we provide. We only provide services under these waivers, and our price is based on you accepting our waivers. By requesting that we perform the work, you are accepting our waivers. If one or part of these waivers is found to be unenforceable, that will not prevent the remaining waivers from being enforced.
Waiver of Damages When Moving Appliance
You understand there is inherent risk when moving appliances. There is a risk of damage to the machine itself and to areas surrounding its installation, including but not limited to flooring, cabinetry, and countertops. You acknowledge the technician is not required to move the appliance. In exchange for their willingness to do so, you promise to hold harmless both the technician and Best Day Appliance from any and every liability associated with any such damage as may occur in connection with this movement.
Waiver of Damages When Working with Water
You understand the machinery being worked on is connected to the building's plumbing system, and whenever any machinery is so connected, there is an inherent risk that component failure, imperfect connections, and/or other faults could result in unintended leakage and/or flooding within the building, causing significant and sometimes catastrophic damage. Excepting cases of gross, clearly proven, and explicitly identifiable negligence by the technician, you promise to hold harmless both the technician and Best Day Appliance, its principals, agents, and employees from any and all damages, harms, or liability that may result from such an occurrence. By allowing the technician to commence work, you explicitly waive the right to any contrary claim.
Waiver of Damages from Failed Cooling Equipment
You understand that, like any machinery, refrigeration equipment consists of complex components, any of which can fail without warning, and that any effort to service and/or repair carries inherent risks. Diagnoses are not always straightforward, and even when carefully performed, repair and/or service work may involve imperfections that result in the failure of the machinery to perform as intended. Such failures may lead to food spoilage, discomfort, inconvenience, and (particularly in commercial contexts) even loss of revenue. You acknowledge that by undertaking to service and/or repair your equipment, Best Day Appliance is not accepting responsibility for any such risks. You agree all such risks are your own alone, and you agree to hold harmless and exempt from liability Best Day Appliance, its agents, and employees from any and all such harms. By allowing the technician to commence work, you explicitly waive the right to any contrary claim.
Waiver of Damages from Lifting Glass Cooktop
You understand that in lifting a glass/ceramic cooktop surface to access components below it, there is an inherent risk of breakage. The top is attached with strong adhesive, and it is not always possible to achieve separation without the surface fracturing. While expecting the technician to exercise every due level of care, you nevertheless recognize that the technician and Best Day Appliance explicitly refrain from accepting any responsibility for these risks. You agree all such risks are your own alone, and you agree to hold harmless and exempt Best Day Appliance, its agents, and employees from any and all such responsibility. By allowing the technician to commence work, you explicitly waive the right to any contrary claim.
REFUSAL OF SERVICE
Best Day Appliance reserves the right to refuse service to a customer at the service technician's discretion. You will be liable for a Service Fee. Service will be refused if:
- You cannot accommodate the service technician.
- You are being disrespectful or belligerent.
- The service technician feels threatened in any way or form.
- You are not properly dressed upon arrival of the service technician.
- You have been or are being disruptive.
- You harass the service technician.
- There are health and safety concerns.
- You refuse to pay for services.
- You are intoxicated or under the influence of illegal drugs, or illegal drugs are present.
